RELEASE OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

IMPORTANT NOTICE

THIS IS A LEGALLY BINDING AGREEMENT.

BY SIGNING THIS DOCUMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS THAT YOU MAY OTHERWISE HAVE, INCLUDING THE RIGHT TO FILE CLAIMS OR LAWSUITS FOR ORDINARY NEGLIGENCE.

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SIGNING.

This Release of Liability, Assumption of Risk and Indemnity Agreement (the “Agreement”) is entered into by and between Amazon Explorer S.R.L. (hereinafter, “Amazon Explorer” or the “Operator”) and the person signing at the end of this document (the “Participant”).

By signing this Agreement, the Participant acknowledges and represents that they have carefully read and reviewed this document, fully understand its contents, voluntarily agree to all of the terms and conditions contained herein, and understand that they are giving up certain legal rights.

1. OPERATOR IDENTIFICATION

I acknowledge that this Agreement is entered into between the Participant and Amazon Explorer S.R.L., a company incorporated under the laws of the Republic of Peru, RUC No. 20493333586, with legal domicile in Iquitos, Loreto, Peru, engaged in the operation of expeditionary and wilderness survival programs in the Peruvian Amazon (“Amazon Explorer” or the “Operator”).

I understand that the contracted services begin according to the official itinerary in Iquitos and end as specified in the program purchased. The Operator’s responsibility is strictly limited to the services expressly included in the contracted itinerary.

2. ACKNOWLEDGMENT OF INHERENT RISKS

I acknowledge and understand that participation in programs conducted in remote areas of the Peruvian Amazon rainforest, including, without limitation, Expeditions, Survival Programs, and Amazon Jungle Challenges, involves significant inherent risks, including, but not limited to, the following:

  • Physical Integrity: Physical injury, illness, permanent disability, or death.
  • Environmental Factors: Exposure to extreme weather conditions, flooding, high humidity, heavy rainfall, and other environmental hazards.
  • Health and Pathogens: The presence of endemic tropical diseases, as well as bacterial, viral, or parasitic infections arising from the natural environment.
  • Flora and Fauna: Encounters with wildlife, insects, reptiles, and other potentially dangerous animals, including venomous, aggressive, or unpredictable species, as well as potentially dangerous flora (including toxic or stinging plants).
  • Hydrological Conditions: Sudden changes in river levels, unexpected flooding, strong currents, or variations in hydrological conditions.
  • Navigation and Water Sources: Risks of Navigation and Water Activities: Hazards arising from river navigation in boats, canoes, or rafts, including collisions, sinking or capsizing, falling into the water, strong currents, encounters with aquatic wildlife, and risk of drowning.
  • Terrain and Travel: Risks of Terrain and Travel: Hazards during hikes and travel across uneven, unstable, flood-prone, or dense rainforest terrain, including falls, slips, landslides, falling branches, and the risk of sprains, fractures, or other physical injuries.
  • Medical Assistance: Limited, delayed, or unavailable access to medical facilities, emergency evacuation, or adequate hospital services.
  • Communications: Failures or limitations in communication systems, including satellite, technological, or radio communications in remote areas.
  • Emergency Logistics: Logistical difficulties resulting from the isolated geographic location, which may affect emergency response times.
  • Psychophysical State: Physical and psychological stress, fatigue, dehydration, or malnutrition.

I acknowledge that these risks are inherent and unavoidable in any contracted program, including Expeditions, Survival Programs, or Amazon Jungle Challenges conducted in remote environments, and that they cannot be eliminated without substantially altering the nature, intensity, and purpose of the experience.

I voluntarily agree to participate and assume full responsibility for my physical integrity and personal safety.

3. NATURE OF THE ACTIVITY AND PROGRAM CONDITIONS

I acknowledge that the Operator offers programs ranging from guided nature tourism experiences to specialized programs, including Expeditions, Survival Programs, and Amazon Jungle Challenges in remote areas of the Peruvian Amazon.

I understand that these programs take place in tropical rainforest environments that may include:

  • Infrastructure and Communications: Limited or nonexistent access to basic services and communication networks.
  • Remote Area Transportation: River and/or air transportation to or from remote areas, including unpaved airstrips or areas with limited infrastructure.
  • Weather Conditions: Exposure to variable, extreme, and unpredictable environmental conditions.
  • Natural Environment: Presence of wildlife and natural environmental hazards.
  • Medical Assistance: Restricted, limited, or delayed access to medical facilities and emergency services.

Depending on the specific program I have contracted, I understand that activities may include, but are not limited to:

  • Psychophysical Demands: Significant physical exertion and psychological stress.
  • Environmental Exposure: Continuous exposure to heat and high humidity.
  • Terrain: Travel through uneven, unstable, flooded, or densely forested terrain.
  • Navigation: Travel by boat, canoe, raft, or other watercraft through rivers and natural waterways.
  • Biological Interaction: Direct contact with wild flora and fauna in their natural state.

I understand that the Operator’s personnel will provide immediate assistance in the event of any accident, concern, or need, provided that such assistance is within the scope of their available resources and logistical capabilities in remote areas.

I confirm and accept that I understand the characteristics and intensity level of my contracted program, as well as its inherent environmental and operational conditions.

4. SELF-SUFFICIENCY PROGRAMS

For self-sufficiency programs, including Amazon Jungle Challenges and Survival Programs, I acknowledge and accept that specific and strict conditions apply, including:

  • Resources and Supplies: The Participant acknowledges that the program operates under self-sufficiency conditions. The Operator will provide only the technical and safety supplies previously defined in the itinerary. Any additional subsistence resources are the sole responsibility of the Participant.
  • Lack of Infrastructure: The Participant acknowledges and accepts that there are no fixed facilities, permanent camps, or sanitary services in these programs. Overnight stays will depend on temporary shelters or the Participant’s ability to build them under supervision.
  • Physical and Mental Demands: Activities require high endurance in unstable terrain and extreme weather conditions. The Participant assumes the risk of fatigue and psychological stress derived from the environment.
  • Tool Handling: The use of machetes and survival gear involves inherent risks of injury, for which the Participant assumes full responsibility, even when used under supervision.
  • Isolation and Evacuation: The program takes place in remote areas where rescue logistics are conditioned by geography and weather. The Participant acknowledges and accepts that the response time for a medical evacuation may be several hours or even days, depending on external factors beyond the Operator’s control.
  • Safety and First Aid: The Operator provides an emergency first-aid kit for basic care and initial stabilization when needed, subject to the availability and limitations of the area where the program takes place.

    The Participant is responsible for carrying their own personal first aid kit appropriate for this type of program.

    The Participant acknowledges that the Operator does not provide advanced emergency communication systems (such as radios or satellite phones) or specialized rescue equipment, which the Participant, at their sole responsibility, may carry provided they have appropriate insurance coverage or external support services.

  • Hydration and Nutrition: The Participant is responsible for their own hydration and must carry a personal water purification system (purification tablets, filter, or an equivalent method).

    The Participant is also responsible for managing their minimum caloric intake using the resources available during the program, whether through limited provisions or provided tools, even when such activities are conducted under the guidance or supervision of the instructors and/or the Amazon Explorer team.

  • Survival Tools: The program provides or allows the use of minimal necessary equipment (such as machetes, hooks, and fishing lines), the proper and safe use of which is the sole responsibility of the Participant, even when used under staff supervision.
  • Technical Staff Support (limited): The Participant acknowledges that the knowledge and supervision of the instructors and/or team constitute a support resource aimed at accident prevention, but do not eliminate inherent risks, replace Participant self-sufficiency, or guarantee safety at any time during the program.

Operational and Methodological Distinction Between Programs

  • Amazon Jungle Challenges: The challenges are organic and arise exclusively from the conditions and rigor of the natural environment in remote areas. The Participant acknowledges that limited food supplies are provided due to the expeditionary nature of the program and the long distances that must be traveled on foot through primary rainforest, where no roads or established trails exist and progress may require cutting a path using machetes. The Participant further acknowledges their commitment to active operational integration with the Amazon Explorer team and other group members, collaborating in all activities throughout the program.

    During the program, the Participant may apply, together with the team, survival techniques to address various challenges inherent to the environment. The Participant acknowledges that these activities are an essential component of the challenge and assumes responsibility for their active participation under conditions of self-sufficiency, even when such activities are carried out under the guidance or supervision of the team.

  • Survival Programs: No food is provided; the Participant acknowledges that the absence of provisions is an essential component of the training. The Operator may implement controlled and induced stress conditions (such as the restriction of food and equipment) as part of the training.

    The Participant may receive instruction in techniques for obtaining natural resources; however, it is their responsibility to apply such techniques and ensure their own subsistence under conditions of self-sufficiency, assuming the inherent risks associated with the lack of provisions, even when such activities are conducted under the guidance or supervision of the instructors and/or the Amazon Explorer team.

Acceptance of Limitations of Assistance and Liability

The Participant acknowledges that, due to the remote nature of the environment, emergency assistance, evacuation, or response may be limited, delayed, or dependent on external factors beyond the Operator’s control.

The Participant accepts that the Operator’s personnel will exercise reasonable professional judgment regarding any intervention, which will be limited to situations involving a real and immediate risk of serious harm.

I confirm that I have fully read and understood the characteristics, intensity levels, and risks of the Self-Sufficiency Programs. I acknowledge that my safety primarily depends on my own judgment and capabilities, and I release the Operator from any liability arising from environmental conditions, logistical limitations of rescue, and inherent risks accepted in this document.

5. ARRIVAL IN IQUITOS – PROGRAMS WITH OR WITHOUT FLIGHTS

Programs without flights included in the itinerary: I acknowledge the necessity of arriving in Iquitos at least one (1) day prior to the start of the program and planning my departure at least one (1) day after its conclusion, in order to ensure my full and punctual participation in all activities.

Programs with flights included in the itinerary: I acknowledge that I must be present in the city of Iquitos at least one (1) day prior to the start of the program. This is because air operators or relevant authorities may require my presence very early on the day of the flight, and schedules are subject to confirmation or modification on short notice. My early arrival ensures that I can punctually comply with flight requirements and last-minute operational arrangements.

6. NO-SHOW POLICY

Programs without included flights: I understand that failure to appear on the scheduled date and time for the start of the program will be considered a No-Show or late cancellation, resulting in the forfeiture of 100% of the total reservation amount, with no right to a refund, rescheduling, or transfer to another date.

Programs with included flights: I acknowledge that failure to arrive on time to board an initial flight, whether operated by the Peruvian Air Force (FAP) or a charter flight, will be considered a No-Show, and the full cancellation policy will apply.

I understand that these flights are subject to FAP scheduling and may be canceled or rescheduled due to weather or operational conditions, which may result in departures on the following or subsequent days. Therefore, I agree to maintain flexibility with additional days at the end of my itinerary to accommodate potential changes.

I acknowledge that the cancellation conditions are governed exclusively by the Terms and Conditions of Amazon Explorer S.R.L., which I have read, understood, and accepted in full at the time of booking.

7. VOLUNTARY ASSUMPTION OF RISK

I acknowledge and accept that participation in the programs offered by the Operator involves inherent, foreseeable, and unforeseeable risks, including, but not limited to:

  • Physical Integrity: Serious injury, permanent disability, or death.
  • Health and Diseases: Tropical diseases, bacterial, viral, or parasitic infections.
  • Wildlife: Bites, stings, envenomation, or attacks from wildlife, including venomous, toxic, or unpredictable species.
  • Allergic Reactions: Severe or anaphylactic allergic reactions.
  • Weather Conditions: Dehydration, hypothermia, heat stroke, or other illnesses related to extreme weather conditions.
  • River Navigation: Navigation accidents, including collisions, capsizing, or falling overboard or into the water.
  • Air Transportation: Aircraft accidents, forced landings, mechanical failures, severe turbulence, human error, or other incidents related to commercial, private, or military air transportation operated by third parties.
  • Terrain and Environment: Falls, slips, or injuries on uneven, unstable, or dense rainforest terrain.
  • Psychological Factors: Significant psychological stress, anxiety, emotional disturbances, or other mental health impacts arising from the extreme environment, isolation, physical or psychological pressure, or the demanding and risky nature of the activities.
  • Medical Evacuation and Rescue: Significant delays, limitations, or the impossibility of medical evacuation or rescue due to remote location, adverse weather conditions, the inability to operate aircraft or river vessels, logistical constraints, operational restrictions, or failures in transportation or evacuation services provided by third parties.

I knowingly, voluntarily, and expressly assume full responsibility for the risks described above, as well as for any other known or unknown, foreseeable or unforeseeable risks directly or indirectly associated with my participation.

My participation is entirely voluntary, and I choose to engage with full awareness of the physically demanding, environmentally challenging, and mentally strenuous nature of the activities.

To the fullest extent permitted by applicable law, I expressly assume all such risks, including those arising from the Operator’s ordinary negligence, except in cases of willful misconduct or gross negligence to the extent prohibited by applicable law.

8. RELEASE AND WAIVER OF LIABILITY

On my own behalf and on behalf of my heirs, successors, legal representatives, and assigns, I hereby:

  • Irrevocably and unconditionally release, waive, and discharge the Operator, as well as its owners, directors, officers, employees, guides, contractors, agents, and affiliates, from any and all liability for injury, illness, damage, loss, disability, or death, whether known or unknown, foreseeable or unforeseeable, arising out of or related to my participation in the expedition, including any expeditionary or wilderness survival program contracted.
  • Expressly waive any right to bring claims, demands, lawsuits, or legal proceedings against the Operator for any damages or losses arising from such participation, including, without limitation, claims based on ordinary negligence, statutory liability, breach of duty of care, or any other theory of liability permitted by applicable law.
  • Expressly acknowledge and agree that this release and waiver includes, without limitation, liability arising from acts or omissions constituting the Operator’s ordinary negligence.

This release does not apply in cases of willful misconduct or gross negligence to the extent that such exclusion is prohibited under applicable Peruvian law.

I understand and agree that this release is intended to be as broad and inclusive as permitted by applicable law.

9. MEDICAL FITNESS, CONSENT, AND EVACUATION

I represent and warrant that I am physically and mentally fit to participate in any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, and that I do not suffer from any medical, psychological, or physical condition, whether known or unknown, that may increase my risk or the risk of others beyond those inherent in high-risk activities conducted in remote rainforest environments, unless such condition has been fully disclosed in writing to the Operator prior to my participation.

I understand that these programs take place in isolated areas with limited infrastructure and communications, and without immediate access to advanced medical care.

I hereby expressly and irrevocably authorize the Operator and its personnel to:

  • Basic Medical Assistance: Provide first aid and basic medical assistance.
  • Emergency Medical Coordination: Arrange and coordinate emergency medical treatment and hospital care.
  • Medical Evacuation: Arrange medical evacuation by land, river, or air, including aircraft operated by military or private services when available.
  • Emergency Decision-Making: Make reasonable medical and logistical decisions in emergency situations when I am unable to provide informed consent.

I acknowledge and accept that, due to the remote, isolated, and environmentally challenging nature of the expedition, emergency response, medical evacuation, and access to advanced medical care may be significantly delayed, limited, or unavailable, and cannot be guaranteed under any circumstances.

I assume full and exclusive responsibility for all costs associated with medical treatment, evacuation, specialized transportation, rescue services, search and rescue operations, and any related expenses, including, without limitation, air evacuation and extended hospitalization, whether foreseeable or unforeseeable.

I understand and agree that the Operator does not act as an insurance provider, and that all costs arising from any medical emergency are my sole and exclusive responsibility, regardless of my decision to obtain personal insurance or not.

10. FITNESS AND MEDICAL CONDITION

I acknowledge that my participation in this program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, is strictly voluntary. I declare that I possess the health and physical condition necessary to complete the program, and I fully assume all risks associated with any pre-existing medical condition, whether known or unknown, that may be aggravated or manifest during the activity.

  • Fitness to Participate: I declare that I possess the adequate physical, medical, and psychological condition to participate in physically demanding activities in remote tropical rainforest environments. I confirm that I have assessed my health status and assume full responsibility for any pre-existing conditions.
  • Duty to Disclose: I undertake to inform the Operator in writing, prior to the start of the program, of any relevant medical condition, severe allergy, required medication, or physical limitation that may affect my safety or the safety of other participants.
  • Medical Authorization: I authorize the Operator to share relevant medical information with rescue, evacuation, or hospital personnel when necessary for my medical care.

11. ADDITIONAL SPECIFIC RISKS

I expressly acknowledge that the activities described include particular risks arising from river navigation, falls into water, strong currents, and changing hydrological conditions. I accept that these risks may result in serious injury or death.

  • Drowning Risk: I acknowledge the risk of drowning arising from water activities, including boat navigation, falls into water, and unpredictable currents.
  • Risk of Death: I accept that the activities may result in serious or fatal injuries due to the extreme and remote nature of the expedition.

12. MEDIA RELEASE

I authorize the Operator to use photographs or audiovisual material captured during my participation in the program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, for promotional, educational, or documentary purposes, in any medium or format and without financial compensation, unless otherwise indicated in writing prior to the start of the program.

  • Purpose of Use: Promotion, education, or documentation of the expedition.
  • No Compensation: No additional payment will be provided unless previously agreed in writing.
  • Right to Opt-Out: The participant may limit usage by notifying the Operator in writing before the start of the program.

13. TRAVEL INSURANCE – PROVISIONS AND DECLARATION

I acknowledge that, due to the remote nature of Amazon Explorer’s operational areas, the Operator strongly recommends that the Participant maintain valid, adequate, and fully effective international travel and medical insurance throughout the duration of the contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges.

I understand and agree that all costs arising from a medical evacuation or emergency services shall be the sole responsibility of the Participant.

While such insurance is not mandatory, it is strongly recommended and should ideally provide coverage for:

  • International medical coverage.
  • Medical evacuation (MEDEVAC).
  • Repatriation. 
  • Search and rescue in remote areas.

Declaration of Coverage: I acknowledge that it is my sole responsibility to decide on the purchase of such insurance. By signing this Agreement, I formally declare my status regarding said policy and understand that the Operator acts under the principle of good faith, assuming that the information I provide is truthful.

In the Event of Not Having Personal Insurance: I expressly acknowledge and accept that I assume all risks and costs arising from any medical emergency, evacuation, rescue, or any situation that exceeds the basic coverage, should Amazon Explorer maintain a policy.

Supplemental Insurance: I further acknowledge that Amazon Explorer may provide limited supplemental insurance; however, such coverage does not replace or reduce my responsibility to maintain adequate personal insurance.

Assumption of Costs: I expressly agree that the Operator shall not assume any financial responsibility, under any circumstances, for medical expenses, evacuation, search and rescue operations, repatriation, or any related costs, regardless of whether I have personal insurance or the existence of any supplemental coverage provided by the Company. I personally assume all expenses that exceed existing policies or the absence thereof.

Insurance Certification: I certify my insurance status by selecting the corresponding option in the registration form linked to this Agreement, which constitutes my formal declaration of coverage or, in its absence, the personal assumption of all associated risks. I acknowledge that my participation will not be formally confirmed until my insurance declaration has been recorded.

14. FLIGHTS OPERATED BY THE PERUVIAN AIR FORCE (FAP)

I acknowledge and accept that certain programs, including Expeditions, Survival Programs, and Amazon Jungle Challenges, may include flights operated by the Peruvian Air Force (Fuerza Aérea del Perú – FAP) or other government or military entities.

I understand and agree that:

  • FAP Flight Interruptions: Flights operated by the Peruvian Air Force (Fuerza Aérea del Perú – FAP) do not operate under fixed or guaranteed schedules and may be canceled or rescheduled for one or more subsequent days due to weather conditions, airstrip availability, or operational factors beyond the Operator’s control.
  • Operational Control: The Operator has no authority or control over military (FAP) or government flight operations.
  • Limitation of Liability: The Operator shall bear no responsibility for delays, missed connections, or additional costs resulting from such operations.
  • End-of-Program Delays: If a return flight to Iquitos is postponed or canceled, resulting in missed domestic or international connections (including flights to Lima or onward), the Operator shall have no liability.

Personal Responsibility: I acknowledge that coordinating all subsequent travel arrangements is my sole responsibility, and I voluntarily assume all risks associated with missed connections or logistical changes arising from the operationally complex nature of the Amazon region.

15. TRANSPORTATION AND THIRD-PARTY SERVICES

I acknowledge and accept that certain services associated with the program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, and including, without limitation, transportation and lodging, may be provided by independent third parties.

To the fullest extent permitted by applicable law, I agree that the Operator shall not be liable for any acts, omissions, negligence, failures, or decisions of such third parties.

I further acknowledge and accept that the transportation associated with any program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, may be operated by independent third parties, including, without limitation, commercial airlines, river vessels, land transportation providers, or government and military entities.

I understand and agree that:

  • Transport Disruptions: Flights and other transport may not operate on fixed schedules and may be subject to same-day delays or rescheduling to one or more subsequent days due to weather conditions, runway or route conditions, or operational factors at both origin and destination.
  • Itinerary Modifications: The itinerary may be modified due to weather conditions, river levels, force majeure events, operational requirements, safety considerations, or decisions made by third-party providers.
  • No Schedule Guarantees: The Operator does not guarantee arrival or departure times, schedule continuity, or the feasibility of travel connections.
  • Missed Connections: The Operator shall not be liable for missed domestic, regional, or international connections, including connections to or from Iquitos, and I assume full responsibility for coordinating all onward travel arrangements.
  • Consequential Costs: The Operator shall bear no responsibility for indirect, incidental, consequential, punitive, or special damages arising from such disruptions, including, but not limited to, additional accommodation, meals, rebooking fees, replacement tickets, or other related expenses.

16. FORCE MAJEURE AND REFUND POLICY

I acknowledge and accept that the Operator shall not be liable for delays, modifications, interruptions, or cancellations resulting from events beyond its reasonable control, including, without limitation:

  • Extreme Weather Conditions: Severe weather, heavy rainfall, rising river levels, flooding, or conditions affecting the operability of unpaved airstrips.
  • Air Operational Restrictions: Rescheduling, delays, or cancellation of flights due to weather conditions, route limitations, technical constraints, or operational decisions by airlines or pilots.
  • Natural Disasters: Natural disasters or environmental crises.
  • Sociopolitical Factors: Political instability, strikes, or regional blockades.
  • Government Regulation: Sudden changes in governmental regulations or access restrictions to protected areas (e.g., SERNANP).
  • Third-Party Transportation: Cancellations, delays, or disruptions in transportation services operated by third parties.
  • Health Emergencies: Health emergencies, pandemics, epidemics, or government-imposed travel restrictions.
  • Other Force Majeure Events: Any other event qualifying as force majeure.

I acknowledge and accept that, in programs involving air transportation to or from remote areas:

  • Loss of Program Days: Rescheduling or delay of inbound flights may result in partial loss of program days, which may not be recoverable, particularly in programs with both inbound and outbound flights.
  • Limited Recovery: Recovery of lost days may only be possible where program logistics allow (e.g., river or land return), without constituting any obligation of the Operator.
  • Costs Due to Return Delays: In the event of delay or cancellation of outbound flights, all additional expenses, including accommodation, meals, transportation, and any related costs, shall be borne exclusively by the Participant.
  • Missed Connections: The Operator shall not be responsible for missed domestic or international flights, onward connections, or travel itineraries.
  • Alternative Transport: Any decision to arrange charter flights or alternative transportation shall be entirely at the Participant’s expense, who is responsible for verifying whether their personal insurance (if any) covers such additional costs.

I expressly agree that no refunds, whether partial or full, shall be granted for delays, interruptions, or days lost under such circumstances.

The Operator’s responsibility is strictly limited to providing reasonable assistance in rescheduling or modifying the itinerary where feasible; however, all additional costs arising from such events shall be borne exclusively by me.

17. INDEMNIFICATION

I agree to indemnify and hold the Operator (Amazon Explorer S.R.L.) harmless from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees and court costs) arising out of or related to:

  • Personal Conduct: My conduct, actions, or omissions during the course of any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, are my sole responsibility.
  • Legal Compliance: Any violation of local laws, regulations, or environmental rules in force within the Republic of Peru.
  • Third-Party or Property Damage: Damage to property, loss of the Operator’s equipment, or injury caused to third parties by my negligence or behavior.

I understand and agree that this indemnification obligation shall survive the termination of this Agreement and the conclusion of my participation in any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges.

18. LIMITATION AND EXCLUSION OF LIABILITY

To the maximum extent permitted by law, I acknowledge and agree that the Operator shall not be liable to the participant for:

  • Consequential Damages: I acknowledge and agree that the Operator shall not be liable for loss of income, lost profits, or loss of economic opportunities arising from any incident during the course of any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges.
  • Indirect or Incidental Damages: Any expense, loss, or harm that is not a direct and necessary result of a covered event.
  • Punitive or Special Damages: Claims intended to punish or serve as a financial example, beyond compensation for actual damages sustained.

19. NON-RELIANCE

I acknowledge that I am not relying on any representation, statement, or warranty not expressly set forth in this Agreement.

  • Prevalence of the Agreement: I understand that the terms of this document prevail over any other prior communication.
  • External Materials: Promotional materials, marketing content, or advertisements do not modify the terms of this Agreement.
  • Verbal Statements: Verbal statements made by any representative of the Operator do not create any additional rights or obligations with respect to my participation in any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges.

20. ENTIRE AGREEMENT

I acknowledge that this Agreement constitutes the entire agreement between myself and the Operator and supersedes all prior oral or written communications, representations, or agreements.

  • Supersession of Agreements: This document supersedes any prior conversations, emails, understandings, or agreements, whether verbal or written, related to my participation in any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges. This Agreement constitutes the entire understanding between the Participant and the Operator.
  • Amendments: I understand that any modifications to the terms of this Agreement shall only be valid if made in writing and signed by both parties.
  • Integrity: No additional promises or benefits shall be valid unless expressly detailed within this text.

21. GOVERNING LAW AND JURISDICTION

I acknowledge that this Agreement shall be governed by and construed in accordance with the laws of the Republic of Peru.

  • Jurisdiction: I agree that any dispute, claim, or controversy arising from or related to my participation in any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, shall be submitted exclusively to the jurisdiction of the competent courts of the city of Iquitos, Peru, under applicable Peruvian law.
  • Exceptions: The above shall apply unless otherwise required by mandatory consumer protection laws applicable to my country of residence.

22. PREVAILING LANGUAGE

This Agreement may be executed in both Spanish and English versions. Both versions are considered equally valid; however, in the event of any discrepancy, inconsistency, or difference of interpretation between the two, the Spanish version shall prevail, to the extent permitted by applicable law.

23. SEVERABILITY

I acknowledge and agree that if any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect and remain binding on me.

24. CLASS ACTION WAIVER

To the maximum extent permitted by applicable law, I agree that any dispute arising from or related to my participation in any contracted program, including Expeditions, Survival Programs, and Amazon Jungle Challenges, shall be brought strictly on an individual basis and not as part of a class, collective, or representative action.

25. ACKNOWLEDGMENT

By signing below, I confirm that:

  • I have carefully read this Agreement.
  • I fully understand its contents.
  • I sign it voluntarily and without coercion.
  • I understand that I am waiving certain legal rights.
  • I have had the opportunity to seek independent legal advice prior to signing this Agreement.

I ACKNOWLEDGE THAT I HAVE READ, UNDERSTOOD, AND VOLUNTARILY ACCEPT THE ENTIRETY OF THE TERMS OF THIS LIABILITY RELEASE AGREEMENT (VERSION 2026-A), WHICH CONSISTS OF 25 SECTIONS AND CONSTITUTES A COMPLETE AND LEGALLY BINDING DOCUMENT.

I DECLARE THAT THIS DOCUMENT HAS BEEN MADE AVAILABLE TO ME IN ITS ENTIRETY FOR MY REVIEW, AND THAT MY ACCEPTANCE IS GIVEN FREELY, EXPRESSLY, AND WITH FULL INFORMED CONSENT, WITHOUT RESERVATION.

MY PARTICIPATION IN ANY CONTRACTED PROGRAM, INCLUDING EXPEDITIONS, SURVIVAL PROGRAMS, AND AMAZON JUNGLE CHALLENGES WITH THE OPERATOR, IS EXPRESSLY CONDITIONED UPON MY STRICT COMPLIANCE WITH THE TERMS SET FORTH HEREIN.
