“The Participant acknowledges and understands that participation in the program involves inherent risks, including but not limited to environmental, logistical, and health-related hazards, and voluntarily assumes all such risks.”

“These Terms and Conditions constitute the entire agreement between the parties and supersede all prior representations, communications, negotiations, or agreements, whether written or oral.”

“This Agreement shall be governed by and construed in accordance with the laws of the Republic of Peru, and any dispute arising hereunder shall be subject to the jurisdiction of the courts of Iquitos, Loreto, Peru.”

Amazon Explorer SRL, with its operational base in Iquitos, Peru, is a company specialized in expedition programs, as well as survival training and challenges conducted in remote areas of the Amazon rainforest.

These Terms and Conditions constitute a legally binding agreement between Amazon Explorer SRL (hereinafter referred to as “Amazon Explorer” or “the Company”) and the Participant who makes a reservation for any of the programs offered.

By making a reservation, submitting payment, or participating in any program, the Participant expressly acknowledges having read, understood, and fully accepted the present document, recognizing the nature of the activities and the inherent risks described herein.

GENERAL TERMS OF SERVICE

To ensure operational safety and compliance with our operational standards, participation in Amazon Explorer programs is subject to the following age and guardianship requirements: 

• Individual Participation: The minimum age to independently reserve and participate in any Amazon Explorer program is 18 years.

• Participation of Minors (Under 18): Participants under 18 years of age must be accompanied at all times by a parent or legal guardian. If a minor travels accompanied by a guardian who is not one of their parents, a written authorization signed by both parents and duly notarized or apostilled in the country of origin will be required.

• High-Risk Programs: Participation of minors under 16 years of age is not permitted in High-Risk Programs, including Amazon Jungle Challenges, Survival Programs, and Extreme Expeditions.

To formalize participation in any program, the Participant must strictly comply with the submission of the following documents:

• Official Identification: A valid passport (or national ID for Peruvian citizens). Timely submission of this document is a mandatory condition to formalize registration.

• Travel Insurance (Recommended): Amazon Explorer strongly recommends that the Participant obtain valid international travel insurance covering the entire duration of the program, including at a minimum: emergency medical expenses, medical evacuation (MEDEVAC), and repatriation (see Section 3).

  Insurance Declaration: The Participant’s insurance status (whether they have obtained such insurance or not) must be declared through the Liability Waiver form, where the Participant must select the option corresponding to their situation.

• Personal Information Form: The Participant must complete and submit this mandatory document. The information provided is essential for operational, logistical, and safety purposes, and enables the provision of services tailored to the Participant’s profile.

• Liability Waiver: The Participant must complete, sign, and submit this mandatory document. The reservation shall not be considered confirmed, nor shall the commencement of the program be authorized, until it has been received by Amazon Explorer.

  Participant Declaration and Acknowledgment: By signing the waiver, the Participant certifies and declares that the information provided is true and accurate, declares their insurance status (including the selection of the corresponding option), and expressly accepts the inherent risks of the program.
  Release of Liability Form

The complete and timely submission of all required documents is a mandatory condition for participation in the program. Failure to provide any of these documents will result in the inability to confirm the reservation or commence the program.

Due to the remote nature of the areas in which Amazon Explorer operates and the limited access to immediate medical assistance, the Participant acknowledges the importance of maintaining adequate travel insurance coverage throughout the entire duration of the program, as well as the financial risks associated with its absence.

• Minimum Insurance Requirements: The Participant is strongly advised to maintain valid international travel insurance for the entire duration of the program, which must include at a minimum:

• • International medical coverage.
  • Medical evacuation (MEDEVAC).
  • Repatriation.
  • Search and rescue in remote areas.

• Participant Declaration: The Participant must indicate their insurance status by selecting the corresponding option in the Liability Waiver Form.

• Absence of Personal Insurance: The Participant acknowledges and agrees, freely, knowingly, and unequivocally, that they assume full and exclusive responsibility for all risks and costs arising out of or in connection with any medical emergency, evacuation, rescue, or the arrangement of a private (charter) flight. Furthermore, the Participant understands that any assistance, coordination, or support that Amazon Explorer may provide shall be strictly voluntary and shall not, under any circumstances, constitute an obligation on the part of the Company.

• Certification of Information: Amazon Explorer operates under the principle of good faith, assuming that all information provided by the Participant is accurate. Any false or misleading statement shall be the sole responsibility of the Participant and shall constitute a material breach of this Agreement.

• Company Basic Insurance: Amazon Explorer may, at its discretion and without constituting a contractual obligation, maintain a basic insurance policy with limited coverage during its programs. The existence, validity, and terms of such policy do not constitute a contractual obligation on the part of the Company.

  If such a policy is in force, it is strictly complementary, does not in any case replace personal travel insurance, and its application is subject to the terms, conditions, exclusions, and limits of the insurance provider. Amazon Explorer assumes no responsibility whatsoever for its availability, activation, scope, or effective coverage, nor for the denial of coverage, nor for any medical, evacuation (MEDEVAC), or repatriation expenses that exceed the limits or terms of such policy.
  Amazon Explorer Insurance Policy

• Scope of Responsibility: The Participant’s obligation to assume all risks and costs applies regardless of the existence or non-existence of any basic insurance policy Amazon Explorer may have available.

• Condition of Participation: The Participant acknowledges that obtaining personal travel insurance is their sole responsibility. The absence of such insurance does not prevent participation in the program; however, it implies full acceptance of all financial risks associated with its absence.

• Insurance Claims: Any claims related to trip cancellations, illness, accidents, loss of personal belongings, delays, charter flight arrangements, or other situations covered by an insurance policy must be managed directly between the Participant and their insurance provider. Amazon Explorer will not act as an intermediary nor assume responsibility for decisions made by the insurer.

By registering for any program, the Participant declares under their sole responsibility that:

• Physical and Mental Condition: The Participant affirms that they are in adequate physical and mental condition for the selected program, acknowledging that these programs take place in tropical rainforest environments which, by their nature, involve uneven terrain and limitations regarding immediate access to urban services.

• Health Declaration: The Participant declares that they do not suffer from any medical conditions, injuries, or illnesses that could worsen during the program, except for those previously disclosed in the Personal Information Form.

• Medications and Allergies: Participants are responsible for carrying their personal medications throughout the program and for declaring any food or medical allergies in advance.

• Participant’s Medical Responsibility: Amazon Explorer does not perform medical checks or screenings. The Participant is solely responsible for ensuring that they are in adequate physical and medical condition to participate in the program.

• Right to Restrict Participation: Amazon Explorer reserves the right to limit or suspend the participation of any individual who, in the reasonable judgment of the operational team, does not demonstrate the minimum physical or mental requirements necessary to ensure their own safety or that of the group. Such decisions may result in removal from the program without the right to a refund.

• Personal Health Responsibility: Participants acknowledge that activities take place in remote natural environments where health risks may exist, including tropical climate conditions, insects, wildlife, and endemic diseases. Participants are responsible for adopting recommended preventive measures and managing their own health condition throughout the program.

Meals provided during Amazon Explorer programs are designed to ensure operational efficiency in the field, adjusting to seasonal availability and the logistical limitations of the remote Amazon environment.

AVAILABILITY AND LOGISTICS 

• Food Supply and Variety: Meals include a variety of dishes, including local cuisine options, depending on the seasonal availability of ingredients.

• Meals in Standard Programs: In standard programs, Amazon Explorer provides three daily meals (breakfast, lunch, and dinner), aiming for variety and nutritional balance within the logistical constraints of the environment.

• Availability of Fresh Foods: Due to tropical climate conditions and transportation limitations, fresh foods such as meat, fruits, and vegetables may have limited shelf life and availability.

• Transition to Preserved Foods: On programs of more than five (5) days in duration, the transition to and use of preserved or long-lasting food products shall be considered an inherent and unavoidable condition of the service.

SPECIAL DIETS 

• Limited Dietary Options: Only in programs lasting up to five (5) days may Amazon Explorer provide vegetarian, vegan, or gluten-free options, provided these requirements are communicated at the time of reservation.

• Requests After Reservation: The Participant is responsible for informing any dietary restrictions at the time of booking. The implementation of dietary adaptations is not guaranteed if such restrictions are not communicated with sufficient notice prior to the start of the program, nor for requests made after booking or once the program has commenced.

LIMITATIONS REGARDING DIETS, ALLERGIES, AND CROSS-CONTAMINATION 

• Exemption of Responsibility: Due to storage and food handling limitations in remote field camps, Amazon Explorer cannot guarantee the complete absence of allergens or strict adherence to specialized dietary requirements.

• Cross-Contamination: Amazon Explorer cannot ensure that food is entirely free of allergen traces or cross-contamination.

• Acceptance of Risk: Participants acknowledge and accept that Amazon Explorer shall not be held liable for allergic reactions or dietary intolerances of allergens resulting from the logistical impossibility of segregating ingredients.

OBLIGATION TO ADAPT AND PROVIDE SUPPLIES 

• Self-Sufficiency of the Participant: Participants with critical dietary needs must provide and transport their own supplementary food supplies.

• Adaptation to Available Meals: Participants agree to adapt to the meals provided by Amazon Explorer during the programs, unless specific dietary requirements were previously declared and confirmed.

• Exemption from Claims: Amazon Explorer shall not be held responsible for claims related to lack of variety or specific nutritional preferences.

AMAZON JUNGLE CHALLENGES AND SURVIVAL PROGRAMS 

• Extreme Conditions: Programs classified as “Amazon Jungle Challenges” or “Survival” are intentionally designed to promote self-sufficiency and adaptation to extreme conditions of food scarcity.

• Specialized Diets Not Provided: Amazon Explorer does not provide or adapt specialized diets and is not responsible for any dietary restrictions, including vegetarian, vegan, or gluten-free diets.

• Medical Responsibility and Assumption of Risk: Participants expressly assume the risks inherent to the program’s dietary limitations and release Amazon Explorer from any liability arising from dietary restrictions imposed by the nature of the itinerary. Participants are responsible for obtaining confirmation from a qualified health professional that their physical and metabolic condition allows them to safely undertake programs involving high physical demand or caloric restriction.

Amazon Explorer programs are not conventional tours. They are expeditions and survival training experiences conducted in remote areas of the Peruvian Amazon, where infrastructure may be limited or non-existent.

By registering for the program, the Participant acknowledges and accepts the following conditions:

• Remote Environment and Isolation: Programs take place in rainforest areas with limited or no access to telecommunications (mobile or internet) and restricted access to immediate medical services.

• Rustic Operational Standard: The programs prioritize authenticity and operational efficiency over comfort. This may include rustic campsites, field-prepared meals, and transportation using locally adapted river vessels.

• Accommodation and Infrastructure: Programs may involve staying in field camps or traditional community dwellings. Infrastructure is basic and typical of remote Amazon rainforest environments. Amazon Explorer does not provide luxury services or lodge-style accommodations; rustic conditions are an integral part of the experience.

• Expedition Operational Dynamics: Programs may include extended river travel, flights to remote areas in small aircraft, trekking through demanding terrain, and exposure to variable tropical weather, including high temperatures, humidity, and heavy rainfall.

• Interaction with the Natural Environment: Participants may encounter wildlife and plant species native to the Amazon ecosystem. Participants must follow all safety and environmental protocols established by Amazon Explorer.

• Logistical Unpredictability: Due to the nature of the Amazon environment, itineraries may be modified due to weather, river levels, operational conditions, or requirements from local communities, without altering the essential nature of the program.

• Nature of the Experience: Participants acknowledge that rustic conditions, exposure to the natural environment, and a certain degree of unpredictability are inherent to the nature of the program. These factors do not constitute deficiencies in service delivery or a breach of contract.

Amazon Explorer programs are developed through an operating model adapted to the social, geographical, and operational conditions of the Peruvian Amazon. Our programs take place in remote areas with limited infrastructure. Consequently, certain operational aspects of the program may depend on local resources, availability of regional personnel, and logistical conditions inherent to the area.

• Nature of Operations in Remote Areas: All programs are conducted in remote areas of the Amazon rainforest and permanently involve the participation of local community members and regional providers. Activities are carried out in accordance with the inherent conditions of these environments and are adapted to the season (dry or rainy), weather conditions, and river levels.

• Integration of Local Personnel and Community Support: Amazon Explorer integrates, on a permanent basis, personnel from local communities within its areas of operation into its team, including local guides, assistants, and other collaborators. This operational model directly contributes to the economic support of the communities where the programs take place.

• Substitution of Personnel: Should the initially planned local personnel be unavailable due to operational, logistical, or force majeure reasons, the Company may transfer collaborators from Iquitos or other locations to ensure the continuity of the program.

• Local Resource Management: As part of the operating model in remote areas, various resources used during programs—including boats, engines, and other equipment—may be rented from local providers in the operational areas. The availability and operability of these resources depend on the technical and infrastructure conditions inherent to the Amazon region. Consequently, their characteristics meet functional operating standards for remote areas and do not necessarily align with the aesthetic or comfort criteria of conventional tourism.

• Agreements with Local Communities: In programs conducted within indigenous territories or communal-use areas Amazon Explorer operates under agreements and authorizations established with the local communities. These agreements regulate access, permitted activities, and specific operating conditions within such areas.

PARTICIPANT-REQUESTED MODIFICATIONS

Due to the nature of programs in remote areas of the Amazon, operations may require adjustments during execution.

• Environmental Conditions: Requests to modify the itinerary or scheduled activities by participants will be evaluated based on logistical feasibility. Such adjustments must not compromise the safety, schedule, or experience of other group members.

• Private or Customized Itineraries: Itineraries designed exclusively for a specific client or group require the hiring of a private service. Modifications to these itineraries are subject to the terms of the private agreement.

• Operational Authority and Compliance: The Amazon Explorer Leader or the operational team, who command the program, have full authority to approve or deny changes requested by the Participant and to make adjustments as necessary to maintain safety and proper program execution. The Participant agrees to comply with these decisions.

ITINERARY FLEXIBILITY DUE TO CAUSES BEYOND THE COMPANY’S CONTROL

• Nature of Programs: The itinerary serves as a general logistical guide. Due to the nature of operating in remote areas, Amazon Explorer reserves the right to modify, shorten, or alter planned routes and activities to ensure the safety and proper execution of the program.

• Impact of External Transportation: The program may be subject to changes due to delays, rescheduling, or cancellations of third-party transportation services. This includes Peruvian Air Force (FAP) flights, commercial or charter air services, as well as river or overland transport.

• Environmental and Local Factors: Itinerary adjustments may also be necessary due to adverse weather conditions, critical river levels, decisions made by local communities, or other logistical limitations inherent to the Amazon region.

• Participant Claims: Adjustments to the itinerary caused by these external factors are an inherent part of program logistics and shall not give rise to refunds, compensation, or contractual claims of any kind.

General Conduct: Participants are expected to:

• • Follow and respect all instructions provided by the expedition team at all times.
  • Maintain responsible behavior throughout the entire program.
  • Comply with all safety rules established by Amazon Explorer.
  • Not leave designated routes or explore areas independently and must remain under the supervision of the Amazon Explorer team at all times.

Exclusion Due to Misconduct: Amazon Explorer may exclude any participant whose behavior:

• • Endangers their own safety or that of the group.
  • Interferes with the normal conduct of the program.
  • Involves aggressive or irresponsible behavior.
  • Involves the use of illegal drugs.

Right of Exclusion Due to Risk: Amazon Explorer reserves the right to exclude a Participant when their conduct represents a risk to themselves, other participants, the team, or the operation of the program.

Logistical Responsibility in Case of Exclusion: In the event of exclusion, the participant will assume all logistical costs associated with their transfer out of the operational area and will not be entitled to any refund.

Amazon Explorer programs take place in ecosystems of high biodiversity. The Participant acknowledges that any interaction with wildlife and the environment is governed by the following terms:

• Planning and Probability: Itineraries are designed based on historical records, field monitoring, and technical criteria to maximize wildlife observation opportunities. Exploration of remote areas involves natural dynamics, which the Participant acknowledges and accepts as part of the expedition experience. 

• Limitation of Guarantee: Sightings of specific species cannot be guaranteed and do not constitute a contractual obligation on the part of Amazon Explorer. Wildlife presence and behavior are independent and subject to natural factors beyond the Company’s control. 

• Interaction Protocols: Participants must strictly refrain from feeding, touching, capturing, or otherwise interfering with the natural behavior of animals. Any action that compromises the welfare of wildlife is prohibited. 

• Safety and Compliance: Participants are required to follow all instructions provided by the expedition team at all times. Amazon Explorer reserves the right to suspend or remove any participant who acts irresponsibly or ignores safety instructions, without entitlement to a refund.

• Field Ethics: The Company prioritizes passive observation and respect for natural habitats. Participants acknowledge that group safety and environmental conservation take precedence over individual desires for close-up wildlife observation or photography. 

The Participant acknowledges that expedition, survival, and challenge programs in the Amazon involve inherent risks associated with the wild environment that cannot be eliminated. These include, but are not limited to:

• Physical Injuries and Accidents: Risks arising from movement on unstable terrain, falls, extreme physical exertion, handling tools (such as machetes) during survival activities, or accidents during water activities, including the possible capsizing of canoes or other watercraft.

• Biological Interaction: Bites or stings from insects, encounters with wildlife, allergic reactions, or exposure to toxic plants.

• Health and Climate: Tropical diseases and exposure to extreme weather conditions (intense heat, storms, sudden changes in river levels).

• Logistical Limitations: Participants acknowledge that they are in areas of extreme isolation, where access to medical facilities and evacuations may be limited or delayed due to geographic and meteorological factors.

Assumption of Risk: The Participant acknowledges and understands these risks and voluntarily assumes them as an inherent part of the nature of Amazon Explorer’s programs.

Amazon Explorer programs classified as Survival Programs and Amazon Jungle Challenges are designed under a methodology based on technical self-sufficiency in extreme isolation scenarios. By booking and participating in the program, the Participant acknowledges that the purpose of the program is to face the rigor of the natural environment, which entails:

• Physical and Mental Demand: Activities requiring a high level of endurance in unstable terrain, dense jungle, and severe tropical climates.

• Technical Food Limitations:

• • Amazon Jungle Challenges: Food supplies are limited due to the extensive travel distances required during the expedition. These programs are also designed to promote the Participant’s self-sufficiency.

• • Survival Programs: No food is provided. The Participant acknowledges that the absence of provisions is an essential component of the training and assumes responsibility for obtaining natural resources under self-sufficiency conditions.

• Austerity Regimen: Voluntary deprivation of basic comforts, including overnight stays in natural shelters or rustic camps and limited use of resources.

• Field Tool Handling: The use of cutting tools (machetes) and survival equipment, acknowledging the inherent risks of their technical handling under supervision.

• Response to Isolation: Acceptance of operating in areas where evacuation and medical assistance logistics are constrained by geography and climate.

• Training and Instruction: Participants will receive guidance and instruction from the Amazon Explorer team; however, the success of the experience largely depends on the Participant’s adaptability and personal resilience.

Participation in these programs constitutes an explicit acknowledgment of the physical, logistical, and environmental challenges inherent to Survival Programs and Amazon Jungle Challenges, which involve extreme expedition conditions and the application of survival techniques. The Participant voluntarily assumes these risks and expressly accepts these conditions as an essential part of the program.

Arrival and Departure in Iquitos – Programs Without Flights: Participants are advised to arrive in Iquitos at least one (1) day before the start of the program and to schedule their departure from Iquitos one (1) day after the program concludes. This recommendation provides a safety margin for last-minute logistical coordination and potential operational adjustments.

Conditions for Programs that Include Flights: Flights included in our programs are operated by the Peruvian Air Force (FAP) or by local operators to and from remote areas with unpaved airstrips. These flights are subject to the following operational conditions:

• Flight Scheduling: The confirmed flight schedule and departure time are usually communicated the evening prior to departure.

• Cancellations and Rescheduling: Flights may be canceled or rescheduled to the following day or subsequent days due to weather conditions affecting the route and/or local airstrip, or by decisions made by the relevant aviation authorities.

• Baggage Limit: Each participant is allowed a maximum of 10 kg of personal luggage. Any excess baggage will be subject to availability and may incur additional costs or be refused by the air operator.

Operational Conditions and Risks: Due to the remote nature of the destinations, Amazon Explorer will manage transportation logistics with professional diligence; however, exact schedules cannot be guaranteed. Delays, rescheduling, or cancellations may occur due to external factors beyond the Company’s control. Such situations may require flights to be postponed to the following day or subsequent days depending on operator or authority availability. Participants acknowledge and accept this risk and must plan their travel accordingly, allowing for potential itinerary adjustments.

The operation of programs in remote areas involving flights requires prior planning and the active cooperation of the Participant. Compliance with schedules, operational instructions, and logistical recommendations is essential to ensure the safety and continuity of the program. Failure to comply with these provisions may result in the loss of services without entitlement to refund or compensation.

Acceptance of Conditions: The Participant accepts the operational and logistical conditions described in Section 14.

• Advance Arrival: Participants must arrive in Iquitos at least one (1) day before the start of the program.

• No-Show: Failure to comply with this requirement, resulting in the inability to register for or board the scheduled flight, will be considered a No-Show. The cancellation policy established in Section 22 will apply, without entitlement to refund, rescheduling, or transfer of the reservation.

• Safety Margin: For programs that include return flights, participants are strongly advised to allow an additional margin of several days after the completion of the itinerary. This precaution helps accommodate possible flight rescheduling or cancellations that may affect national or international flight connections.

• Limitation of Liability: Amazon Explorer shall not be responsible for missed national or international flight connections or for any additional expenses resulting from rescheduling or cancellations of flights included in the program. This includes, without limitation, accommodation, meals, alternative transportation, or the chartering of private flights.

• Exclusion of Refunds and Compensation: The Participant acknowledges and agrees that, under no circumstances, refunds or financial compensation will be provided for changes, rescheduling, or cancellations resulting from circumstances beyond the control of Amazon Explorer.

• Amazon Jungle Challenges and Extreme Survival: Due to the extreme isolation and unpredictable nature of these territories, participants are responsible for planning a buffer of at least five (5) days after the completion of the itinerary. The Participant acknowledges and fully assumes the risks and costs associated with potential itinerary adjustments or logistical delays that may affect subsequent travel plans.

In the event of flight rescheduling or cancellation (FAP or other operators), the Participant may choose between the following options:

• a) Logistical Waiting Period: Waiting for the solution proposed by the air operator, assuming their own accommodation and meal expenses during the waiting period.

• b) Immediate Alternative: Opting for one of the following alternatives that may be coordinated by Amazon Explorer, under their respective conditions:

• • 1) Itinerary Modification: The program may continue using river transportation (high-speed boats and slow navigation vessels) and land travel, which may include a 50 km jungle trek. This modification may extend the duration of the itinerary and generate additional operational costs, which must be fully assumed by the Participant prior to its implementation.

• • 2) Program Substitution: The original program may be replaced with another program that does not require air transportation. This new itinerary may differ substantially in areas, environmental conditions, and operational characteristics from the original program. Acceptance of this substitution constitutes an explicit and irrevocable waiver of any claim for refund or compensation arising from the differences between the two programs.

• Selection of Alternative: The choice of logistical alternative will correspond to the Participant, who must fully assume the associated costs, operational conditions, and any possible itinerary extensions resulting from the selected option.

• Guidance and Assistance: Amazon Explorer will provide information and guidance solely for the purpose of identifying possible alternative solutions in the event of flight rescheduling or cancellations.

ACKNOWLEDGMENT OF CONDITIONS AND LOGISTICAL RISKS 

• Acceptance of Remote Environment: The Participant declares that they understand that programs conducted in remote and non-touristic areas of the Amazon involve specific logistical challenges. The Participant acknowledges that the execution of the program depends on external factors such as weather conditions, limited access, and the availability of local transportation (air, river, or land).

• Third-Party Services and Risks: The Participant voluntarily assumes the risks arising from services provided by third parties, including regional airlines, local communities, and contracted transportation providers, and releases Amazon Explorer from any liability for delays, rescheduling, or interruptions beyond the Company’s direct control.

INHERENT RISKS IN AMAZON EXPLORER PROGRAMS 

• Rainforest Environment: The Participant acknowledges that program activities take place in a rainforest environment subject to real and unpredictable natural risks.

• Assumption of Physical Risks: The Participant voluntarily assumes the risks of injury, insect bites, bites (including snake bites), contact or interaction with wildlife, tropical diseases, or accidents arising from the terrain and the nature of the activities included in the program.

• Responsibility and Preparedness: The Participant declares that they possess adequate physical and mental preparation and commits to strictly following the safety protocols and instructions provided by Amazon Explorer’s specialized personnel.

GENERAL LIMITATION OF LIABILITY

• Events Beyond Control: Amazon Explorer shall not be liable for economic losses, damages, inconvenience, or any other harm resulting from Force Majeure events, fortuitous events, or any circumstance beyond the Company’s reasonable control that partially or totally affects the execution of the itinerary. Such events include, but are not limited to:

• • Flight Rescheduling and Operational Restrictions: Rescheduling or cancellation of flights included in the program, as well as restrictions affecting airports or remote airstrips.

• • Natural Phenomena: Natural disasters, adverse weather conditions, or unusual or extreme river levels.

• • Civil Disturbances and Conflicts: Civil unrest, social conflicts, strikes, transportation blockades, or decisions made by governmental, local, or community authorities.

• No Right to Refund: Any delay, modification, or interruption of the program resulting from such events shall not entitle the Participant to any refund or financial compensation.

• Custody of Personal Belongings: Amazon Explorer shall not be responsible for the loss, theft, damage, deterioration, or misplacement of equipment, money, documents, cameras, electronic devices, or other personal items during the program. The Participant assumes full responsibility for safeguarding their belongings against loss, theft, damage, or environmental conditions such as humidity, rain, or immersion. Amazon Explorer will only be liable in cases where gross negligence or direct and proven responsibility of its personnel can be demonstrated.

OPERATIONAL COMMITMENT AND FLEXIBILITY 

• Operational Decisions: Amazon Explorer will execute the program with the highest level of professional diligence. The Participant acknowledges and accepts that, for reasons of safety, logistics, or environmental conditions, the operational team may adjust routes, activities, schedules, or itineraries—even without prior notice—when deemed necessary for the safety of the group or the viability of the operation.

RESCHEDULING AND CANCELLATIONS OF FLIGHTS INCLUDED IN PROGRAMS 

• Air Transport Assistance Options: In the event of rescheduling, postponement, or cancellation of flights included in the program (FAP or other operators) due to external factors, the Participant may choose among the assistance alternatives described in Section 16 (Air Transport Contingencies and Cancellations).

• Exclusion of Financial Liability: Regardless of the option selected under Section 16, the Participant acknowledges and accepts that all additional expenses—including accommodation, transfers, alternative transportation, missed national and/or international connections, or the purchase of new flight tickets—shall be borne exclusively by the Participant. Amazon Explorer shall not be responsible for refunds or compensation for unused services.

EARLY WITHDRAWAL, PROGRAM ABANDONMENT, OR CHANGE OF PROGRAM 

• Release of Liability: Once the program has begun, Amazon Explorer SRL shall not be responsible and will not issue refunds if the Participant decides to abandon the itinerary or must withdraw due to physical incapacity, illness, accident, or voluntary decision.

• Logistical Costs of Withdrawal: The Participant shall assume all logistical costs arising from early withdrawal, including air, river, or land transportation, meals, accommodation, and any escort personnel required to facilitate their transfer to Iquitos or the nearest connection point.

• Exclusion of Refunds: No refund will be issued for unused days of the program or unused services.

• Change to a Tourism Program: If the Participant requests to switch to a tourism program after having started a survival program, such modification will be subject exclusively to the operational availability of Amazon Explorer. All additional costs resulting from this change shall be fully borne by the Participant.

OPERATIONAL COMMITMENT AND CONTINUITY 

• Full Compensation of Operational Staff: Amazon Explorer guarantees full payment of fees, salaries, permits, and allowances—including transportation, meals, and accommodation—for all operational personnel (guides, assistants, boat operators, and community logistics staff) throughout the entire duration of the program. This obligation shall remain in effect regardless of the Participant’s continued participation in the program, including in cases of early withdrawal for any reason.

• Exclusive Reservation and Opportunity Cost: The Participant acknowledges that, upon confirming a reservation, Amazon Explorer blocks the operational dates and declines other booking requests to ensure service exclusivity and quality. Therefore, the Participant accepts that withdrawal or cancellation once the program has begun represents a lost business opportunity that cannot be recovered by the Company.

• Irrevocability of Operational Costs: Human and technical resources are mobilized and reserved exclusively for the Participant. Any interruption, early withdrawal, or partial cancellation does not release Amazon Explorer from its financial obligations to its staff and suppliers. Consequently, no refunds, credits, or deductions from the total contract cost will be granted under any circumstances once the program has begun.

The Participant acknowledges and agrees that all additional expenses arising from external causes, force majeure events, or circumstances beyond the control of Amazon Explorer related to air transportation shall be borne exclusively by the Participant. This includes, but is not limited to:

• • Accommodation and Transfers: Additional accommodation, meals, and transfers in urban centers and/or local towns.

• • Alternative Transportation: River, land, or air transportation arranged as an alternative to the original itinerary.

• • Private Charter Flights: Costs associated with private charter flights contracted as part of the program.

• • Lost Program Days: Activities or services not used due to flight delays, rescheduling, or cancellations.

• • Missed National or International Flights: Any missed flights, whether domestic or international, shall not entitle the Participant to any form of compensation.

• • Penalties and Replacement Tickets: All costs related to flight rescheduling or the purchase of new domestic or international tickets, including fare differences and applicable penalties, shall be the sole responsibility of the Participant.

BOOKING PROCESS AND FORMALIZATION 

• Initial Procedure: The Participant shall indicate the desired itinerary and program date. Amazon Explorer will confirm availability and the final price before accepting any payment. A reservation is formalized only after the required deposit has been received and verified.

• Reservation Deposit: To formalize and secure the reservation, a deposit equivalent to fifty percent (50%) of the total itinerary cost is required, or full payment (100%) when specified in the reservation confirmation.

• Guaranteed Reservation: A reservation shall not be considered confirmed, guaranteed, or binding until the required deposit has been properly credited to the official accounts of Amazon Explorer SRL and its receipt has been verified by the Company.

BOOKING DEADLINES (MINIMUM ADVANCE NOTICE) 

Due to the logistical complexity of our operations, the following minimum booking timeframes apply:

• Pacaya Samiria National Reserve: 7 days prior to the start of the itinerary.
• Amazon Tribes:                               60 days prior to the start of the itinerary.
• Extreme Expeditions:                     60 days prior to the start of the itinerary.
• Jungle Survival:                              60 days prior to the start of the itinerary.
• Amazon Jungle Challenges:         90 days prior to the start of the itinerary.

PAYMENT DISPUTES AND CHARGEBACKS 

By making a payment, the Participant acknowledges and accepts the terms established in these Terms and Conditions. Any attempt to initiate a payment reversal, bank dispute, or chargeback without contractual basis shall constitute a breach of this agreement.

Amazon Explorer SRL reserves the right to present this document, payment confirmations, and the Participant’s acceptance of these terms as evidence before the corresponding financial institutions or payment platforms.

• Payment Instructions: To complete your reservation or settle any outstanding balance, please use one of the following payment methods. The Participant is responsible for carefully verifying the information before making any transfer.

• Net Amount and Transaction Fees: Only the net amount effectively credited to the accounts of Amazon Explorer SRL will be considered valid payment. The Participant is responsible for covering all bank fees, transfer charges, intermediary bank fees, or platform fees, so that the amount received is not reduced by such charges. The total amount received by Amazon Explorer SRL, including amounts credited to its accounts and any outstanding balance, must match the total cost of the program.

• Price Adjustments and Cost Variations: Quoted prices are based on the operational costs in effect at the time of booking. Amazon Explorer reserves the right to adjust the program price in the event of significant increases beyond the Company’s control in logistical costs, permits, fuel prices, third-party transportation rates (including air or river transport), or changes in government regulations and applicable taxes. Any such adjustment will be communicated to the Participant in advance.

  If the Participant does not accept the communicated price adjustment, the reservation will be considered cancelled at the Participant’s request, and the conditions established in the applicable Cancellation Policy (see Section 22) will apply.

• Payment Confirmation: Amazon Explorer will only consider a payment received once the net amount has been effectively credited to the official bank accounts of Amazon Explorer SRL.

• Payment Validity: The official payment date shall be the date on which the funds are confirmed and verified by the Company. Regardless of the date on which the Participant issued the transfer order. The submission of digital payment confirmations does not constitute proof of receipt until final accreditation of the funds.

• Deadline for Bank Transfers: To ensure that funds are credited before the start of the program, any payment made via international bank transfer must be completed at least seven (7) business days in advance. This requirement is independent of the date on which the reservation was made.

• Payment Receipts: Once the payment has been made, the Participant must send the corresponding payment receipt via email or WhatsApp for registration and verification purposes.

• Full Balance Payment: The total cost of the program must be fully paid before the start of the itinerary. Any outstanding balance must be settled no later than 24 hours before the program begins.

  When payment is made via bank transfer, it must be initiated at least seven (7) business days in advance to ensure proper accreditation. If the Participant is within seven (7) days of the program start date, cash payment will be the only accepted method.

  Verification of the full payment constitutes an essential condition for the start of the program. In the absence of such verification, Amazon Explorer shall not be obligated to begin or provide the contracted services until the outstanding balance has been fully settled.

• Program Start Condition: The commencement of any program is strictly subject to the effective accreditation of the transferred funds in the accounts of Amazon Explorer SRL. If the corresponding amount has not been credited before departure, the reservation will be considered invalid and the itinerary cannot begin until the pending payment has been fully regularized.

• Cash Payments: n Iquitos, payments in United States dollars (USD), euros (EUR), or Peruvian soles (PEN) are accepted. The exchange rate applied will be the rate determined by Amazon Explorer on the day of payment.

• Condition of Banknotes (USD and EUR): US dollar (USD) and euro (EUR) banknotes must be in perfect condition (without marks, tears, folds, stamps, or stains). Due to strict acceptance policies within the Peruvian banking system, Amazon Explorer reserves the right to refuse banknotes that do not meet these standards.

• ATM Withdrawals: Automated teller machines (ATMs) in Iquitos may have limitations for withdrawals using international cards or may impose reduced daily withdrawal limits. Participants are advised to ensure they have access to sufficient funds to complete any remaining program payments before the program begins.

Retention Percentages: In the event of cancellation by the Participant, Amazon Explorer will apply the retention percentages indicated below.

These percentages will be calculated exclusively on the net amount effectively credited to the Company’s accounts up to the date of cancellation, after deducting any bank commissions or platform charges applied to the initial payment.

The applicable retention will be determined according to the time remaining between the cancellation notice and the start date of the itinerary.

Pacaya Samiria National Reserve Programs

• More than 60 days: 30% retention.
• 59 to 30 days:          40% retention.
• 29 to 10 days:           70% retention.
• Less than 9 days:   100% retention.

Extreme Expeditions, Amazon Tribes, and Jungle Survival Programs

• More than 60 days: 40% retention.
• 59 to 30 days:           70% retention.
• 29 to 10 days:           80% retention.
• Less than 9 days:    100% retention.

High-Complexity Programs: Amazon Jungle Challenges and Extreme Survival 

• No Refund Policy: These programs require critical logistical planning and involve non-recoverable financial commitments with third parties from the moment the reservation is confirmed. Any payment made for these itineraries is non-refundable and non-transferable to another program or date, regardless of the reason for cancellation.

ADDITIONAL CANCELLATION CLAUSES 

• No-Show: Failure of the Participant to appear at the scheduled date and time for the start of the itinerary will be considered a late cancellation. This will result in the loss of 100% of the total reservation value, with no entitlement to refund, rescheduling, or transfer of the reservation to another date, person, or program.

• Arrival Requirements and Flights: For itineraries that include initial flights (such as Peruvian Air Force – FAP flights or charter flights), the Participant must be in Iquitos at least one (1) day prior to the scheduled departure. Failure to comply with this requirement, resulting in the inability to board the flight, will be handled under the No-Show policy.

• Refund Processing Costs: In cases where a partial refund applies, it will be calculated solely on the net amount effectively received by Amazon Explorer SRL. All expenses, bank commissions, platform charges, or taxes associated with the refund transfer (including PayPal fees, sending banks, or intermediary banks) shall be fully borne by the Participant and deducted from the final refundable amount. Amazon Explorer shall not be responsible for exchange rate fluctuations, third-party banking fees, or differences resulting from currency conversions.

The following provisions establish the final terms that complement these Terms and Conditions, including personal data protection, the use of images recorded during the programs, and the applicable legal framework for the resolution of any dispute.

PERSONAL DATA PROTECTION 

• Regulatory Compliance: In accordance with Law No. 29733 (Peruvian Personal Data Protection Law) and aligned with international standards of the General Data Protection Regulation (GDPR), Amazon Explorer informs the Participant that the personal data provided in reservation forms, health declarations, and liability waivers will be treated with strict confidentiality.

• Purpose: The data will be used exclusively for the logistical management of programs and itineraries and to ensure the safety of the Participant, including relevant medical information.

• Security Measures: Amazon Explorer implements technical and organizational measures to prevent alteration, loss, or unauthorized access to personal information.

• ARCO Rights: The Participant may exercise their rights of access, rectification, cancellation, and opposition by submitting a written request to: peru@amazonexplorer.com

• Third-Party Transfers: The data will only be shared with service providers and third parties necessary for the execution of the program, including those required for transportation arrangements, as well as for the processing of permits with competent authorities, local communities, and administrative entities, under the same conditions of security and confidentiality.

IMAGE RIGHTS AND AUDIOVISUAL RECORDINGS 

• Authorization for Use: During the development of the programs, Amazon Explorer may capture photographic and video material. Unless the Participant expressly communicates otherwise in writing before the start of the itinerary, the Participant authorizes the use of their image (photography and video) free of charge, on a non-exclusive and worldwide basis, for promotional, advertising, educational, or informational purposes in the Company’s websites, social media platforms, and printed materials.

JURISDICTION AND APPLICABLE LAW 

• Dispute Resolution: This contract shall be governed by the laws of the Republic of Peru. Any dispute, disagreement, or claim arising from the interpretation, execution, or fulfillment of this document shall be expressly submitted to the jurisdiction and competence of the courts of the city of Iquitos, Loreto, Peru, with both parties waiving any other jurisdiction that might correspond to them by reason of their present or future domicile.

• Prevailing Language: These Terms and Conditions may be provided in multiple languages for the convenience of the Participant. However, in the event of any discrepancy, ambiguity, or conflict between the Spanish version and any translation into another language, the Spanish version shall prevail for all legal and interpretative purposes.

By confirming the reservation and making the deposit payment to Amazon Explorer S.R.L., the Participant declares, acknowledges, and agrees that they have read, understood, and fully accepted these Terms and Conditions in their entirety. This binding acceptance includes, without limitation: the cancellation and refund policies; provisions relating to travel insurance and medical evacuation (MEDEVAC); the mandatory execution of the Liability Release; conditions arising from Force Majeure; the discretion of Amazon Explorer to modify itineraries for operational, climatic, or logistical reasons (including air transportation); provisions relating to personal data protection; and the applicable legal jurisdiction.

Furthermore, the Participant acknowledges that the payment of the deposit constitutes a formal, express, and irrevocable acceptance of all the terms of this agreement, which govern the contractual relationship between the parties.
